CONCERNING
STIPULATION OF QUANTITY AND KINDS OF RATTAN WHICH CAN BE EXPORTED

THE DIRECTOR GENERAL OF FOREIGN TRADE,

Considering:

a. that in the framework of implementing Decree of the Minister of Industry and Trade No. 355/MPP/Kep/5/2004 on regulation of the export of rattan, it is necessary to stipulate the quantity and kinds of rattan which can be exported;
b. that in relation thereto, it is necessary to issue a decision of the Director General of Foreign Trade;

In view of:

1. Presidential Decree No. 102/2001 on status, tasks, functions, authority, organizational structures and working arrangements of ministries;
2. Presidential Decree No. 109/2001 on first-echelon organizational units and tasks of ministries;
3. Decree of the Minister of Industry and Trade No. 558/MPP/Kep/12/1998 on export general provisions as already amended several times and the latest by Decree of the Minister of Industry and Trade No. 519/MPP/Kep/8/2003;
4. Decree of the Minister of Industry and Trade No. 86/MPP/Kep/3/2001 on the organization and working arrangement of the Ministry of Industry and Trade;
5. Decree of the Minister of Industry and Trade No. 355/MPP/Kep/5/2004 on regulation of the export of rattan;
6. Decree of the Minister of Industry and Trade No. 359/MPP/Kep/5/2004 on the appointment of surveyors as executors of verification or technical inquiry into the export of rattan;
7. Decision of the Director General of Foreign Trade No. 17/DAGLU/KP/VI/2004 on provisions and technical procedures for the export of rattan;

Observing:

1. Letters of the Head of the Central Kalimantan Provincial Industry and Trade Service No. 512/749/INDAG/VII/2004 dated July 23,2004 and No. 512/798/VIII/ 2004 dated August 7,2004;
2. Deliberation Meeting of Stipulation of the Quantity of Rattan which can be exported in 2004 - 2005, dated September 30,2004;

DECIDES:

To stipulate:

THE DECISION OF THE DIRECTOR GENERAL OF FOREIGN TRADE ON STIPULATION OF QUANTITY AND KINDS OF RATTAN WHICH CAN BE EXPORTED.

Article 1

(1) Rattan, which can be exported in this decision shall be raw rattan, semi-finished rattan in the form of rattan core and bark originating from rattan cultivation, covering kinds of taman, sega and irit subsumed into Tariff Heading HS EX. 1401.20.00.00.

(2) The quantity of the rattan as meant in paragraph (1) which can be exported in the November - December 2004 period shall be stipulated as follows:

- Raw rattan of taman, sega and irit kinds resulting from cultivation with a diameter of 4 - 16 mm, 21,500 (twenty one thousand and five hundred) tons;
- semi-finished rattan in the form of rattan hark and core of taman,sega, and irit kinds resulting from cultivation, 16,400 (sixteen thousand and four hundred) tons.

Article 2

(1) The Director of Export of Agricultural Products and Mining in issuing approval of the quantity and kinds of rattan which can be exported shall be in accordance with Decree of the Minister of Industry and Trade No. 355/MPP/Kep/5/2004 and Decision of the Director General of Foreign Trade No. 17/DAGLU/KP/VI/2004.

(2) The Director of Export of Agricultural Products and Mining in issuing approval of the quantity and kinds of rattan which can be exported shall consider the availability of the need for domestic industries and developments of rattan price in the country and abroad.

Article 3

With the issuance of this decision, Decision of the Director General of Foreign Trade No. 28/DAGLU/KP/VIII/2004 on provisional stipulation of the quantity and kinds of rattan which can be exported shall be declared null and void.

Article 4

The decision shall come into force as from the date of stipulation.
